A proposed class action settlement has been reached in the case of McGivney, et al., v. ITS Technologies & Logistics, LLC, Case No. 2026-LA-000924, pending in the Circuit Court of DuPage County, Illinois. On September 6, 2026, the Court preliminarily approved the Settlement and, by agreement of the parties, certified this lawsuit to proceed as a class action for settlement purposes only.
If, between September 8, 2017, through August 29, 2024, you used a partial handprint or fingerprint scan timeclock in connection with your employment with Defendant in the State of Illinois, you may be a member of the Settlement Class. Excluded from the Settlement Class are (1) Persons who timely and validly elect to exclude themselves from the Settlement Class; (2) the Court and staff for this case and any member of their immediate family; (3) Persons who previously released the claims at issue in this action; and (4) all persons whose employment was governed by a collective bargaining agreement. If you are a member of the Settlement Class, then you are entitled to compensation under the terms of the proposed Settlement.
The proposed Settlement is not an admission of wrongdoing by Defendant, and Defendant denies that it violated the Illinois Biometric Information Privacy Act or any other law. The Court has not decided who is right or wrong. Rather, to save the time, expense, and distraction of litigation, the parties have agreed to settle the lawsuit.
This website and the Notice contain only a summary of the Settlement Agreement. Your legal rights are affected whether you act or don’t act. Read this website carefully.
